Yes, absolutely. The Constitution protects everyone in the United States regardless of citizenship or immigration status. These claims can be brought under New York State law and under 42 U.S.C. Section 1983 in federal court.

Qualified immunity is a legal defense that shields police officers from personal liability unless they violated a clearly established constitutional right. Department of Social Services, which is not protected by qualified immunity. In 2021, New York City also banned qualified immunity for excessive force cases in NYC civil court.
